Terms of Service

1. Acceptance of Terms

By accessing or using Cookd (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free-tier, subscription-based, and Lifetime Deal (LTD) holders.

2. Lifetime Deal (LTD) — Terms, Revocation & Fair Usage

The Launch LTD (“₹999 Lifetime Deal”) is a one-time purchase product designed for personal, non-commercial use. The following terms apply specifically to LTD holders:

• LTD accounts are granted for the lifetime of the Service as it exists at the time of purchase, subject to the terms below.
• LTD is a single-user license. You may not share, resell, transfer, or sublicense your LTD access to any other person or entity.
• The LTD is revocable under the following conditions: (a) violation of these Terms, including the Fair Usage Policy and User Conduct provisions; (b) commercial resale or redistribution of AI-generated outputs as a standalone service; (c) abusive, fraudulent, or illegal use of the Service; (d) automated or scripted access, scraping, or bulk processing that imposes an unreasonable burden on our infrastructure.
• If your LTD is revoked for cause, you will lose access to the Service permanently. No refund will be issued, as revocation is a consequence of your breach of these Terms.
• The LTD is a single-purchase product and access is granted for as long as the Service operates. If the Service is discontinued entirely, no refund will be provided. By purchasing the LTD, you acknowledge and accept this risk. This is common industry practice for lifetime deals, where the “ lifetime” refers to the lifespan of the product, not your personal lifetime.
• Fair Usage Policy: LTD accounts are intended for genuine personal use. If usage exceeds 300 AI-generated replies per month for 3 consecutive months while exhibiting patterns consistent with automated or commercial use (e.g., bulk processing, scripted requests, reselling outputs), we may reach out to discuss a suitable plan. Maximum of 5 context screenshots processed per active generation thread. These thresholds may be adjusted at our discretion with notice.

3. Subscription Plans (Crush Pass & Match Pro)

Crush Pass (₹99/week) and Match Pro (₹249/month) are recurring subscription plans. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Cancellations take effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing cycle.

4. Credits & Usage Limits

Each plan is allocated a monthly credit pool (exact number displayed at checkout). One AI generation consumes one credit. Screenshot processing, context analysis, and profile audits consume credits at the rates displayed in-app. Unused credits expire at the end of each billing period and do not transfer.

5. User Conduct

You agree not to: (a) use the Service for any illegal purpose or in violation of any laws; (b) attempt to reverse-engineer, scrape, or automate the AI generation pipeline; (c) resell or redistribute generated replies as a standalone service; (d) upload content that violates any third-party rights or contains hate speech, harassment, or explicit non-consensual material. Violation may result in immediate termination and revocation of your license (including LTD) without refund.

6. Data Privacy & Storage

Chat screenshots and context data are processed solely to generate replies. Uploaded images are not stored permanently; they are deleted within 24 hours of processing. We do not train our models on your data. For full details, see our Privacy Policy. By using the Service, you consent to this processing.

7. Intellectual Property

You retain full ownership of any content you upload. Generated replies are provided as suggestions; you are solely responsible for deciding whether and how to use them. The Service name, logo, branding, and underlying AI models are the intellectual property of Cookd and may not be reproduced without explicit written permission.

8. Service Availability & Modifications

We strive for 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily suspended for maintenance, updates, or emergency fixes. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice. LTD holders will be notified via email at least 30 days before any material reduction in service. In the event of full Service discontinuation, see Section 2 for LTD refund terms.

9. Limitation of Liability

Cookd provides AI-generated suggestions for entertainment and conversational assistance. We do not guarantee specific outcomes (e.g., dates, replies, matches). To the maximum extent permitted by law, Cookd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim. For LTD holders, liability is limited to the purchase price of the LTD.

10. Refund Policy

Lifetime Deal purchases are final and non-refundable, except where required by applicable consumer law. No refund will be provided if the Service is discontinued or modified, as the LTD is a pre-purchase of access for the lifespan of the product, not a guaranteed service period. Subscription plan refunds are handled on a case-by-case basis within 7 days of purchase. To request a refund or report an issue, contact support@cookdai.site with your order ID and reason.

11. Termination & LTD Revocation

We reserve the right to suspend or terminate accounts, and to revoke Lifetime Deal licenses, under the following circumstances:

• Violation of any provision of these Terms, including User Conduct (Section 5) and Fair Usage Policy (Section 2).
• Engaging in abusive, fraudulent, or illegal activity through the Service.
• Failure to pay applicable fees for subscription plans.
• Attempting to circumvent usage limits, access controls, or payment requirements.
• Upon termination or revocation, your access to the Service ceases immediately. LTD holders whose licenses are revoked for cause will not receive a refund. Subscription holders will not be refunded for the current billing period. We will notify you via email of any termination or revocation and the reason for it. You may appeal by contacting ${EMAILS.support} within 14 days of the notice.

12. Governing Law & Dispute Resolution

These terms are governed by the laws of India. Any disputes arising from these terms shall be resolved exclusively in the courts of Mumbai, Maharashtra. For consumers in the EEA or UK, nothing in this section deprives you of the protection of mandatory consumer protection laws in your country of residence. We encourage you to contact us first to resolve any dispute informally before pursuing legal action.

13. Changes to Terms

We may update these Terms of Service at any time at our sole discretion. Changes take effect immediately upon posting to this page, except for material changes which will be communicated via email or in-app notification. Your continued use of the Service after any changes constitutes acceptance of the new terms. If you do not agree to a material change, you may stop using the Service. No refund will be provided for discontinuing use due to terms changes.
